These Terms and Conditions (“Terms”) constitute a legally binding agreement between PHILinspect Property Inspection Services (“Company,” “we,” “us,” or “our”), a business entity duly organized and existing under the laws of the Republic of the Philippines with office address at 47 Dona Rita Diaz Fortunata Village
San Isidro, Parañaque, Philippines, and you, the user or customer (“Client,” “you,” or “your”).

By accessing our website, purchasing our products, or engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Refund Policy.

1. Scope of Services and Transactions

1.1. Platform Purpose: This website serves as a service-based platform for property inspection services and professional services.

1.2. Eligibility: By using this site, you represent that you are at least eighteen (18) years of age and possess the legal capacity to enter into binding contracts under Philippine law.

2. Order Placement and Perfection of Contract

2.1. Offer and Acceptance: The display of products or services on this website constitutes an "invitation to offer." A contract is deemed perfected only upon our issuance of an Order Confirmation or Official Receipt (OR) sent to your registered email.

2.2. Verification: We reserve the right to verify the authenticity of any transaction. We may request government-issued identification or proof of billing to prevent fraudulent transactions, in compliance with the Cybercrime Prevention Act of 2012 (RA 10175).

2.3. Accuracy of Information: The Client is responsible for providing accurate delivery addresses and contact details. The Company shall not be liable for failed deliveries due to erroneous information provided by the Client.

3. Pricing, Payments, and Taxation

3.1. Currency: All prices are quoted in Philippine Pesos (PHP).

3.2. Taxes: In compliance with National Internal Revenue Code (NIRC) regulations, all prices are inclusive of 12% Value-Added Tax (VAT) unless otherwise explicitly stated.

3.3. Payment Channels: Payments may be settled via Unionbank. Bank Transfer and InstaPay QR.

3.4. Price Adjustments: We reserve the right to change prices at any time without prior notice. However, once an order is perfected, the price agreed upon at the time of purchase shall remain final.

4. Delivery and Performance of Services

4.1. Standard Delivery: Delivery timelines are estimates and may be affected by Force Majeure (e.g., typhoons, floods, or government-mandated lockdowns).

4.2. Service Scheduling: For inspection services, the Client must ensure that the subject of inspection is accessible at the agreed-upon Barangay/City location. Failure to provide access may result in a "No-Show Fee" or forfeiture of the service fee.

5. Intellectual Property Rights

5.1. Ownership: All content, including but not limited to logos, text, graphics, and the "JuanLaw Draftsman" generated reports, are the exclusive intellectual property of PHILinspect Property Inspection Services and are protected by the Intellectual Property Code of the Philippines (RA 8293).

5.2. Restrictions: No part of this website or its content may be reproduced, distributed, or modified without express written consent from the Company.

6. Data Privacy and Security

6.1. Compliance: We process personal data in strict accordance with the Data Privacy Act of 2012 (RA 10173).

6.2. Consent: By providing your information, you consent to the collection and processing of your data for fulfillment of transactions and marketing purposes (if opted-in).

7. Prohibited Acts

Users are strictly prohibited from:

  • Using the website for any fraudulent or unlawful purposes.

  • Uploading malicious software or "viruses" as defined under the Cybercrime Prevention Act.

8. Limitation of Liability and Indemnification

8.1. Extent of Liability: To the maximum extent permitted by law, the Company’s total liability for any claim shall not exceed the amount paid by the Client for the specific product or service in question.

8.2. Indemnity: You agree to indemnify and hold PHILinspect Property Inspection Services harmless from any claims, losses, or damages resulting from your breach of these Terms or your violation of any Philippine law.

9. Dispute Resolution and Governing Law

9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

9.2. Amicable Settlement: In the event of a dispute, both parties agree to first attempt an amicable settlement through mediation for a period of thirty (30) days.

9.3. Venue: Any legal action or proceeding arising out of these Terms shall be brought exclusively in the proper courts of Pasig City, Philippines, to the exclusion of all other venues.

10. Amendments

The Company reserves the right to amend these Terms at any time. Your continued use of the website following any changes constitutes your acceptance of the new Terms.
