Inspection Disclaimer

This Disclaimer governs all inspection services provided by PHILinspect Property Inspection Services (“the Company”) to the Client (“you”). By engaging our services, you acknowledge and agree to the following terms:
1. Nature of the Inspection Service
1.1. Visual and Non-Invasive: The inspection performed is a visual, non-invasive, and non-destructive assessment of the subject property or item at the specific time and date of the inspection.
1.2. No Dismantling: Our inspectors will not dismantle, move, or undergo any action that might cause damage to the subject of the inspection. Consequently, areas that are concealed (e.g., behind walls, under floorings, inside engines, or within sealed components) are excluded from the scope of this inspection.
1.3. Point-in-Time Assessment: The resulting report reflects the condition of the item only at the time of inspection. The Company does not guarantee that the condition will remain the same after the inspector leaves the premises.
2. Exclusion of Latent (Hidden) Defects
2.1. In accordance with the Civil Code of the Philippines, the Company shall not be held liable for "latent defects"—flaws that are not apparent to the naked eye or discoverable through standard, non-destructive inspection methods.
2.2. The Company does not provide any warranty, express or implied, regarding the future performance, life expectancy, or hidden merchantability of the inspected item.
3. Limitation of Liability
3.1. Maximum Monetary Cap: To the fullest extent permitted by Philippine law, the total collective liability of PHILinspect Property Inspection Services, its employees, and agents for any errors, omissions, or breach of contract shall be strictly limited to a sum not exceeding the total fee actually paid by the Client for the specific inspection service.
3.2. No Consequential Damages: The Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of use, or costs of repair/replacement discovered after the inspection.
4. Third-Party Reliance
4.1. The inspection report is prepared for the exclusive use of the Client.
4.2. PHILinspect Property Inspection Services accepts no responsibility or liability to any third party who may rely on the contents of the report without the express written consent of the Company.
5. Client’s Responsibilities
5.1. The Client must ensure that the subject of the inspection is accessible and in a safe condition for the inspector.
5.2. Any known history of defects or previous repairs must be disclosed to the inspector prior to the commencement of the service. Failure to disclose such information voids any claims against the Company.
6. Dispute Resolution
6.1. Any claim or dispute arising from the inspection service must be filed in writing within 3 calendar days from the delivery of the inspection report. Failure to file within this period constitutes a waiver of the claim.
6.2. All legal proceedings shall be governed by Philippine law and shall be venued exclusively in the courts of Pasay, Philippines.
